Restructuring and Redundancies
Apex Consulting represents both employers and employees in respect of restructuring of businesses and the proper process required before an employee’s employment can be legally terminated by way of redundancy. Examples of questions asked by employers and employees include the following:
Employers
- Our business is struggling financially and we need to reduce our wages bill if we’re to stay afloat
- Are we able to downsize and make some employees redundant?
- Do we have to prove that the business is in a precarious financial position before we can do this?
- Is there a set process the business must follow before we can make an employee redundant?
- I’ve heard that the restructuring process can be long and drawn out. What can happen if we don’t follow the proper process?
Employees
- I have been invited to a meeting in which the employer is proposing to restructure the business and have been advised my employment may be affected by this.
- What can I do if the proposal appears to put my employment at risk?
- What information does my employer have to give me?
- Do I have an opportunity to provide feedback on the proposal?
- If my role is disestablished and I am made redundant, does my employer have to pay me redundancy compensation?
